Copyright Control

Copyright Control module automates contract management and calculation of copyrights received by authors/performers for their works.

Copyright is a set of legal rules regulating matters arising from creation and use of artistic, literary or scientific works such as texts, books, paintings, sculptures, music, illustrations, architecture projects, pictures, photos, etc. The copyright rules enforces respect to those human nature creation on all society members, granting the creators exclusive privileges.

For legal purpose, copyright is divided into moral and property rights.

Moral rights permanently bind the authors and their intellectual creations together, allowing them to protect their own personality.

On the other hand, property rights are those concerning mainly the economical use of intellectual works, by any technical process, either already existing or to be developed. It grants the author exclusive right to use, benefit from, and distribute his creative work, as well as to allow the use by third parties, either totally or partially, defining a true property right enforced by the Brazilian Federal Constitution.

As opposed to moral rights, which are untransferable, imprescriptible, inalienable and irrevocable, property rights can be transferred or assigned to another person, to whom the author grants the representation right or even the right to use his creations. Therefore, without authorization, intellectual work cannot be used in any way. If people use this work without authorization, they will be violating copyright law, which is subject to common law penalties, despite of any criminal penalty.

Copyright comprises authors right and related rights, which are nationally and internationally regulated.

In Brazil, literary, artistic and scientific property is also protected by art. 5, paragraphs XXVII e XXVIII of the current Federal Constitution of 1988, by Federal Law nr. 9,610/98, of February 19, 1998, by articles 184 and 186 of the Penal Code, as well as by all the decrees mentioned above.

Copyright payment is a previous authorization request made to the authors/performers in order to use or reproduce their artistic works.
